VaraKit provides an AI-powered platform that enables users to create websites, manage their digital presence, and access various marketing and business tools. Our services include, but are not limited to:

• AI-powered website builder
• Brand management tools
• SEO and marketing optimization
• Customer relationship management (CRM)
• Social media management
• Website hosting and deployment

2.1 Registration: To access certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Age Requirement: You must be at least 18 years old to create an account and use our Service. By using VaraKit, you represent and warrant that you meet this age requirement.

2.4 One Account Per User: Each user may maintain only one account. Creating multiple accounts may result in termination of all associated accounts.

3.1 Subscription Plans: VaraKit offers various subscription plans with different features and pricing. By selecting a paid plan, you agree to pay the applicable fees as described at the time of purchase.

3.2 Billing Cycle: Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

3.3 Payment Processing: All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your selected payment method for all fees incurred.

3.4 Price Changes: We reserve the right to modify our pricing at any time. Price changes will be communicated at least 30 days in advance and will apply to subsequent billing cycles.

3.5 Credits: Some features may require credits, which can be purchased separately or included in your subscription plan. Unused credits may expire according to the terms specified at the time of purchase.

4.1 Subscription Refunds: If you are not satisfied with our Service, you may request a refund within 14 days of your initial subscription purchase. Refund requests after this period will be evaluated on a case-by-case basis.

4.2 Credit Purchases: Credit purchases are non-refundable once credits have been used. Unused credits from a credit pack purchase may be refunded within 14 days of purchase.

4.3 Renewal Refunds: Automatic renewal charges are generally non-refundable. However, if you forgot to cancel and have not used the Service during the new billing period, you may request a refund within 7 days of the renewal charge.

4.4 Pro-rated Refunds: We do not offer pro-rated refunds for partial months or years of service when you cancel your subscription.

4.5 How to Request a Refund: To request a refund, please contact us at support@varakit.com with your account details and reason for the refund request. We will respond within 5 business days.

5.1 VaraKit's IP: The Service, including its original content, features, and functionality, is owned by VaraKit LLC and is protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content: You retain ownership of any content, data, or materials you upload to the Service ("User Content"). By uploading User Content, you grant VaraKit a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

5.3 AI-Generated Content: Content generated by our AI tools based on your prompts belongs to you. You may use AI-generated content for personal or commercial purposes. However, you are responsible for ensuring that your use of AI-generated content complies with applicable laws and does not infringe on third-party rights.

5.4 Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by VaraKit without any obligation to you.

6.1 Prompt Storage: We store the prompts you submit to our AI tools and the corresponding outputs generated. This data is used to provide the Service, improve our AI models, and troubleshoot issues.

6.2 Data Usage: Your prompts and AI-generated outputs may be used in anonymized and aggregated form to improve our Service. We will not share your identifiable prompt data with third parties without your consent.

6.3 Content Responsibility: You are solely responsible for the prompts you submit and the content you create using our Service. You agree not to use the Service to generate content that is illegal, harmful, or violates third-party rights.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Create or distribute harmful, abusive, or offensive content
• Engage in fraudulent activities or misrepresent your identity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated tools to access the Service without our permission
• Resell or redistribute the Service without authorization
• Create websites that promote illegal activities, hate speech, or violence

8.1 Termination by You: You may cancel your account at any time through your account settings or by contacting us at support@varakit.com. Cancellation will take effect at the end of your current billing period.

8.2 Termination by VaraKit: We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended period of inactivity (12+ months)
• Requests by law enforcement or government agencies

8.3 Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your account data, including websites you have created, within 30 days of termination. We recommend exporting any important data before canceling your account.

8.4 Survival: Sections regarding intellectual property, limitation of liability, indemnification, and governing law will survive termination of these Terms.

9.1 "As Is" Service: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee: We do not guarantee that the Service will be uninterrupted, secure, or error-free. AI-generated content may contain inaccuracies, and you should review all content before use.

9.3 Third-Party Services: The Service may integrate with or contain links to third-party services. We are not responsible for the content, privacy practices, or availability of third-party services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARAKIT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO VARAKIT IN THE 12 MONTHS PRECEDING THE CLAIM.

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Hawaii.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the modified Terms.
